There is no intent to kill, and a resulting death would not be considered murder, but would be considered involuntary manslaughter. The accused's responsibility for causing death is constructed from the fault in committing what might have been a minor criminal act.

I wish her well, and hope she heels from all this. And I hope in time the Conrad's parents can heel as well. I the sentence is 20 yrs, but I don't think the judge has to go by that either, but I could be wrong as well.

She wont do do 20 year youthful offender lucky if she gets more than 10. More than likely 60 months & probation.

Since this thread has become about Dalia Dippolito and Bill Cosby (and Bella Bond maybe?) (upthread there was a post about the prosecutor not being very aggressive and she should have let the guy do it...totally confusing, until I figured out it wasn't about the MC trial) I want to point out that this is a link to an article about Michelle Carter, with a statement by someone from MBA.

Reminds me of MickeySP who was a poster that apparently was a police officer and talked about guns a lot. Not trying to keep track but I do have a pretty good memory.

I was kind of wondering about this person. Not that I read people by this but she normally comes out in trials and says things. Havent seen her in a long time.

Yeah, she took a long break from her traditional postings. I always enjoy reading her. She seems to be pretty accurate. Always a good read at least.

IIRC, MickeySP is a lawyer.
 
Yes I worked in the mental health industry for almost 10 years. I burnt out. I switched careers to LE almost 30 years ago. Old woman now at 56.
 
Sentencing hearing is happening now, I think. Conrad's mother is speaking. I caught the tail end of his dad's speech.

ETA: It's actually a lawyer speaking for his mother.
 
I too hope she gets a lenient sentence and a LOT of mental health help. Don't get me wrong, what she did was terrible. It just seems to me that she had some kind of physic break but her defense could not convince the judge that she was sick enough to not be held responsible. It's all interesting precedence. If Michelle could be convicted of involuntary manslaughter while she was not physically there, it opens up a whole big can-o-worms with other cyber-bullying cases.

I wonder if she would have fared better with a jury o_O.

Are you sure the judge made the determination of whether or not she was able to be deemed mentally competent for criminal culpability purposes? That's not how I'm familiar with it being done. A defendant would be sent for an intensive mental evaluation at a state forensic center where doctors would make that determination and render their opinion to the court, at which time the judge would either declare whether or not the person had the competency to be adjudicated for criminal responsibility. The evaluations are done over a period of weeks to months.
