Interesting Rules and Regulations

So as I am getting ready to have 2 UYs I thought I should read through the rules regarding transfers for myself. What I came across I thought was pretty interesting (at least to me).

DVC Rules and Regulations

II(6)(j) Club Members are expressly prohibited from receiving compensation for engaging in any Transfer activity.

Does Disney just not care to enforce this at this point because it would be a pain to prove? On the flip side renting your points seems to be allowed per the terms of the document.


Also I found another section:
V(3)(b) When a Club Member uses Home Resort Vacation Points to reserve Vacation Homes on behalf of a nonClub Member, and the Club Member does not charge any rental or other fees to the non-Club Member for the reservation, then the non-Club Member is eligible for all or some of the Club Member privileges and benefits that a Club Member would normally receive during the Club Member’s stay in the reserved Vacation Home. If the non-Club Member is renting, it is the responsibility of the Member to notify Member Services when making the reservation. Member privileges and benefits cannot be extended to non-Club Members who rent Vacation Homes from Club Members.

If you make a reservation but are not charging the other party (maybe like for your parents, children, or significant other) they get member privileges. What are member privileges that they are talking about? How do they prove they get those member benefits as well? I couldn't find any reference to "member privileges" elsewhere in the document.
 
If Someone mentions to DVC they are getting money for the transfer, MS won’t complete it. I think the reason the Language is there is because they do not want to be involved in issues that go wrong. A transfer moves points from one member to another And it can’t be reversed.

So, if there was an issue, and someone paid and it didn’t go well, they can’t complain to DVC.

I had not seen that specific language but I don’t think they would be eligible for any benefits that require a DVC Card...actually I cant think of any other than maybe the free DVD rentals.
 
Interesting. I'm trying to think of member privileges that don't require a card and ID. Obviously they wont have a card that matches an ID.
 
It’s the official policy of DVC, and I believe as a function of timeshare law, that points are tokens of your ownership and have no value in themselves.

So they have a rule to that effect.

Also. If you cannot transfer for money, then DVC is not responsible if a deal goes sideways.

I think the language regarding benefits goes back to when they still used KTTW cards. 'DVC Member' would be printed on the KTTW Cards for point reservations and member benefits extended based on that wording. There must have been a flag in the system that could prevent that from printing if the owner indicated to MS that the renter compensated them.

Use of laundry rooms? I mean, we all know they are open with your band, but maybe renters wouldn’t.

Fwiw they can scan bands and see “Dvc member”. I got a DVC discount on dining a few years back on a solo trip, back when I was the associate and then-husband was the member. It wasn’t expected or asked for (the server asked and just scanned my band), and was very kind.

(For those unaware, associates don’t get a DVC card and aren’t eligible to get benefits that require the card, so this was out of the ordinary)
 


It depends upon the system they are using to scan the bands. The handheld systems at table service restaurants do show DVC and often AP status, but servers are still supposed to see the cards, though I have had servers that said it wasn't necessary when I said, "Just a minute, let me get my DVC or AP card." They do not, AFAIK, show TiW status, but it sure would be nice if all the discount entitlements showed up electronically and were automatically applied.
