Parking at AK

if members stay at AK in one of the hotel rooms, do we pay for parking or not?
 
Are you in a AK hotel room or DVC room? If booked in a DVC room, points or cash parking is free.
 
In a hotel room, you pay to park.

Parking charge is based on unit type not membership.
 


You don't pay to park at a theme park if you are a resort guest. You pay to park at a resort overnight if you booked a room through a source that is not DVC.
 
AKL is part of Disney Collections and if you use points to reserve an AKL hotel room, you do get free parking. If you reserve for cash, you are not supposed to. The rule as stated on the DVC site is:

"Members will not be charged for standard overnight self-parking when staying in a Disney Vacation Club Deluxe Villa at Walt Disney World Resort, Disney's Vero Beach Resort or Disney's Hilton Head Island Resort, regardless of whether they use Vacation Points or another form of payment. Members also will not be charged to park when using vacation points to stay at a Walt Disney World Resort hotel.

"A Member who chooses not to use vacation points for their stay at a Walt Disney World Resort hotel in an accommodation other than a DVC Deluxe Villa will be charged for standard overnight self-parking."​
 


I hope this new "perk" of free parking continues for DVC. It adds a bit more value than before.

My understanding is that DVC owners are already paying for parking, the parking lots and security through our dues.

It's not a new perk, it's just that they are sticking it to hotel guests. $350+ for a room, $100+ a day for a ticket to the parks, now another $17 a day to park... What's next, pay toilets?
 
It is not a perk. It is part of dues.

If they carve it out of dues, all bets are off.

My view is that they cannot legally carve it out of dues or charge us parking fees. This is not like valet parking, which was not specifically covered in the official documents. They took valet services away from us, and started charging us for it, by outsourcing valet services and thus eliminating the dues we were paying for the valet employees.

The parking lots in the resorts are specified to be part of the common elements owned by the members and to which the members have a right of use without charge unless the charge to be made is actually specified in the the DVC resort's Declarations. The official documents specifically require that the members be charged dues for the maintenance and repair of the common elements. As a result the only way that DVC (or Disney) could charge us parking fees is to first remove the parking lots from the common elements so their maintenance could then be removed from dues. That major change in ownership and use rights of members could only occur via a vote of the actual members.

The real issue that exists is whether Disney can legally even charge members for use of the parking lots when the members rent a Disney hotel room for cash. That is actually a somewhat close issue but Disney likely has the better of the argument because it can assert that the parking charge is really just part of the room rental charge

Officially, the dues element supports upkeep at the deeded property. So at a non-DVC, none of the lot would be part of the deeded interest.

Gets harder at, say, the Contemporary.
