ROFR Thread April to June 2024 *PLEASE SEE FIRST POST FOR INSTRUCTIONS & FORMATTING TOOL*

This happened to me a few weeks ago. My contract said an International seller must be disclosed and wasn’t. I backed out of the contract right before I was to sign the closing contract and received my funds back. There was some discussion to convince me that everything would be done correctly, but I had read enough stories here to know it could cost me considerable time and headaches if everything wasn’t done perfectly…not worth the risk for me.
I was just irritated because I did not negotiate the price, and was blind sided until the Contract arrived. I have missed a booking window too. Hope others learn from our mistake … ASK if it is an International Seller!
 
There was one during pandemic that I was simply stunned at, never did find it on Occompt though
I’d love to know what this was. I was checking a bunch of the ROFR thread lowballs during summer 2020 when things got crazy and found the ones I looked for (mostly looking at BCV and SSR which were the ones I was interested in buying)

The one I never found wasn’t a ROFR thread posting but rather a contract I found on Redweek for BCV for 325 points at $61/point. I tried to buy it but was told it had just sold.

This was June or July of 2020. I never saw it come up on OCcomp. I checked for months.

Keeping my fingers crossed on my first purchase. I accepted the offer just before i saw SLACG's post with an even better deal. I think that helped nudge prices lower

An international seller should be disclosed but it would only matter if timing is really critical. If the agent and title company know what they are doing, it should otherwise not be a big issue.

It meant they could not use e-notary, and by the time "mailed" the documents back it added time. Had it been a Big purchase I would have cancelled no matter the timing, while Escrow "holds" the taxes for an International Seller sale - the IRS required MY social security number as a Guarantor for the taxes. There is a reason DISNEY will never ROFR an International Seller contract, I'm guessing they know more than me... YMMV.

If you have 3 people on the contract do all 3 have to supply their ss#?

Notary depends on the country but can be arranged in way that it will only add a few days - no major difference to a 'slow' seller in the US. Had one recently that did not want to do e-notary.

If the agent and title company are familiar with FIRPTA (as they should be), and don't try to be creative this doesn't add risk to the buyer - if the IRS gets the money from the title company everything is fine and the seller can claim it back later.

Disney is a multinational corporate giant - reasons that apply to them might not apply to you.
 
We used a trust and just used one Trustee signature, so I don't know, but did require the Trustee's social security number.
I bid on an overpriced SSR international contract (my opinion) but we were far off. They lowered their asking price on their listing but still not near what I am willing to pay currently.

I’m not thrilled that an International Seller was was not disclosed anywhere on my 100 AUL-S either…

Offer was accepted on 2/5 🥰, went to Disney on 2/8 😁, had to sign an addendum on 2/16🤨, passed ROFR on 2/26🥳, closing docs not received until 3/18 after Cammy no longer handels Hawaii closings 😧, still waiting…. 😵‍💫

Any title companies you recommend to select or avoid?
Just a side note - you might have one company, or an attorney handling escrow, and another issuing the title policy. Not always the same company. I believe it was the title insurance company that would not accept e-notary from Canadian seller.

Unsure if this is allowed…..when looking for contracts to buy, where does everyone look? Newbie here.
 
This is a site that tracks. Www.dvcsearch.com.
That site is not entirely accurate (for example - it only shows https://dvcsales.com/ that are really out of date lol). When you get "serious" know that you need to check all the sites yourself, and pretty regularly, for any good deals. The aggregator sites are not perfect by a long shot ;) but will give you the names of the typical sites to track ...
