Thoughts on Lowball Offer

Okay, we'll put some positive energy out to the universe for a Sept CCV and/or AKV and an Oct OKW (2057 if not too much to ask) and AKV!! Oh, and loaded with points at a steal... Patience is not one of my strong points either LOL! :love:
While we're sending positive vibes and intentions out into the world, I would LOVE to find a small December AKV contract, so if you happen to stumble across December while you're looking for September or October, send them my way!
 
Getting sick of brokers trying to get out of presenting my offer on the ground of "it definitely won't pass ROFR".

1. ROFR is at best a major slow down, more likely, entirely closed
2. Even if they were open no one except Disney knows what price point they will or wont buy back, so if I'm willing to take the gamble then let me, and don't present it as a guaranteed eventuality when it's absolutely not.

That’s completely unethical to not present a valid offer to a seller - and we all know it has nothing to do with ROFR. Which brokers are you using? I think sellers have a right to know that certain brokers are screening out valid offers.

Im waiting AKV with Oct use year too! I am really hoping to wait until fall to purchase but might have to take a shot with an offer if I see a stripped Oct AKV with 100-150 points. I would also be happy with BLT but would need to find a stripped 100 pt BLT with Oct use year.

I had this happen with www.buyatimeshare.com, got the whole "you know Disney is a premium product, I'm embarrassed to present this, they will never accept it and Disney will take it anyways if they do." My offer was low but not that low.

That is disappointing. I put in offers in the past week at about 4 different brokers, all starting $30 below asking, and none gave me a hard time to present.

It's our money. Every dollar of it so they really have no right to moan and groan in my opinion. They still make their commission. $5 less per point is even less on a % commission. If I was them I'd rather just make sales.

I agree, I even had one broker say no hurt in trying because some sellers are taking low offers.

In the end, I did buy only $15/pt below asking, but only because it was the perfect contract and wasn’t going to let $1k stand in the way.

In New Hampshire it is ILLEGAL not to present an offer...just saying
 
In most jurisdictions that I've read through any of the real estate law, offer presentation is typically subject to the written direction of the client. I believe this to be the case in Florida as well (from a quick read through Florida statutes: (e) Presenting all offers and counteroffers in a timely manner, unless a party has previously directed the licensee otherwise in writing). This would mean that all offers would need to be presented UNLESS the seller has given a written direction to the contrary. So a seller could give a written direction to not bother them with offers under $xxx. I'm not saying that is the case necessarily but I also don't like to jump to conclusions about the ethics of a broker without first asking if they have been directed in this manner.

To be fair I've had variations on a theme with several of them, although one who annoyed me in particular today I won't be dealing with again (won't name publicly but happy to share privately)

It might be a British thing, but I'm far more likely to work with & spend more with those who have been much more tolerant of my low-ball offers! Those who give guidance and their view of what will be accepted, but never being condescending, of which I'm pleased to say there have been a good 3 or 4 brokers who have treated me well, so I will stick with those guys!

Some just made the comment my price might be a bit ambigous. The problem I faced was that a lot of current sellers have very different prices in mind. I got a decent deal (138 $/point on a 75 CCV contract with 2020 points), but it took some offers until I found a seller which was - at least- close(r) to the instant pricing.

Id love to find some cheap Riveria points with this economic down turn but the problem is how do you value this resort with the resale restrictions. There haven't been very many of these contracts available as of yet but precovid they were probably around $140 average sale price.. Using my 30% off lowball idea this would mean $98 a point. While this resort is amazing these restriction might devalue this resort even more... Maybe I'll stick with low balling Aulani contract for now and dream of tropical drinks on the beach.

Theres a new contract up for Riviera I saw today with a DEC use year on the dvcresalemarket website. I think it was 130 or 140$ per point so they may take a lower offer
